JACKSONVILLE, N.C. — No charges will be filed against an Onslow County woman who fatally shot her estranged husband after the man killed her boyfriend.

District Attorney Ernie Lee tells news outlets that 32-year-old Monica Rose Smith won’t be charged in the death of 33-year-old Cody Smith.

Officials say Monica Smith shot and killed Cody Smith in an act of self-defense after he killed her boyfriend, 43-year-old Gregory Pearce.

Maj. Chris Thomas says Cody Smith went to the woman’s Richland home Aug. 27, where he restrained her before shooting Pearce several times. He then set the house on fire, untying Monica Smith, who was able to get her husband’s gun, shooting him.

Lee says state law allows for the use of deadly force when the individual believes they are at risk of death.
