RUTLAND, Vt. — A former Rutland city attorney has been sentenced again to four to 10 years in a drunken driving hit-and-run crash that killed a 71-year-old woman.
Christopher Sullivan had appealed his original sentence after being convicted in 2015. Authorities say Sullivan was drunk when he struck Mary Jane Outslay, of Mendon, with his vehicle in April 2013. He was disbarred following the conviction.
The Rutland Herald reports (http://bit.ly/2vmh2zX ) the Vermont Supreme Court overturned the sentencing earlier this year, saying Sullivan should have been able to present expert psychological testimony at the sentencing hearing.
The expert testified Thursday saying Sullivan’s failure to stop after the crash was due to a “fight or flight” response.
The testimony didn’t change the judge’s sentence. Judge Theresa DiMauro says her original sentenced is justified.
