NORFOLK, Va. — Two Virginia men accused of killing a 17-year-old were set free after a witness in the murder case didn’t show up to testify.

The Virginian Pilot reports that Prosecutor LeRon Gilchrist dropped all charges against Tranathan Tyrone Holmes and Demetrius A. Green after the witness backed out of testifying.

The 18-year-olds been accused of killing 17-year-old Kaison “Kai” Mitchell in Norfolk in April.

Robert Smith III, Green’s lawyer, says he was ready to argue that the teen had an alibi. A woman was going to testify that Green and a third man charged in Mitchell’s killing were at her house the night the Mitchell was killed.

A commonwealth’s attorney spokeswoman says the judge ordered the witness to come to court next month to explain why he didn’t show up.
