CEDAR RAPIDS, Iowa — A judge has agreed to move the second homicide trial of a Cedar Rapids man out of Linn County.

The Iowa Appeals Court in May ordered a new trial for Nicholas Luerkens, who’d been found guilty of first-degree murder for the slaying of 29-year-old Lynnsey Donald in Marion. The Appeals Court said the trial court “erred in denying the defendant’s request to submit an insanity defense instruction to the jury.”

Court records say the Linn County judge agreed Tuesday with Luerkens that the trial should be relocated because pretrial publicity. The new location will be announced later, as well as any change in the original trial starting date of Dec. 4.
