ST. JOHNSBURY, Vt. — A judge has ruled against prosecutors trying to keep details of a plea deal secret between a co-defendant scheduled to testify against a Vermont man charged in the kidnapping and killing of a 78-year-old woman.
The Caledonian Record reports the judge denied the state’s request for a protective order Tuesday.
State’s Attorney Lisa Warren argued the documents related to the plea deal for 34-year-old Keith Baird’s half-brother and co-defendant Richard Fletcher were “attorney work product.”
Baird’s attorney says he believes the state needed the plea deal to put his client at the scene of Pat O’Hagan’s killing in 2010. He says Fletcher may tailor his testimony in order to receive less prison time.
Prosecutors say Baird, Fletcher and their cousin entered O’Hagan’s home with the intention of robbing her.
