PRINCETON, W.Va. — A parent challenging Bible classes in a West Virginia school district has filed an appeal to continue the case despite her daughter’s enrollment in another school system.

The Bluefield Daily Telegraph cites a Tuesday release from the Freedom From Religion Foundation announcing the appellate brief filed by attorney Marc Schneider and FFRF Senior Counsel Patrick Elliott on behalf of Elizabeth Deal in her lawsuit against the Mercer County Board of Education.

Last November, Senior U.S. District Judge David A. Faber dismissed the lawsuit, as the all Bible in the Schools teachers had been fired and the board of education had suspended the program for at least a year.

Deal argues that she and her daughter have continued to be ostracized in their community.

The district has 30 days to respond.
