DOVER, Del. — A federal judge says an inmate who claims he is severely mentally ill may have legitimate claims of alleged mistreatment by Delaware prison officials.

The judge on Friday dismissed a lawsuit filed by Juan Restrepo, who is serving 30 years for murder at Vaughn Correctional Center.

But the judge said Restrepo would be allowed to a file an amended complaint alleging that officials have failed to properly treat him and other mentally ill inmates since a riot at Vaughn last year in which a prison guard was killed and three other staffers taken hostage.

Restrepo also will be allowed to file amended claims alleging that he has been the subject of excessive force, and that he was humiliated by being forced to walk through the prison compound chained and naked.
