Man scheduled for retrial on murder charge

COLUMBUS, Ind. — The retrial of a Jennings County man accused of killing his former stepfather is scheduled to begin Wednesday, seven years after a jury failed to reach a verdict in his first murder trial.

A jury was selected Monday in Ripley County to hear the case against Stephen L. Gilmore, 59, of Commiskey. The retrial will be in the Jennings Circuit Court.

Gilmore is charged with murder in the February 2005 shooting death of Billy Akers, 59, who is the ex-husband of Gilmore's mother. Gilmore has claimed that he shot Akers in self defense when Akers tried to force his way into his home after an argument.

A six-day trial in August 2005 ended with a hung jury after 12 hours of deliberation. Jurors unanimously found Gilmore not guilty of murder but reached an impasse when deciding whether he was guilty of the lesser charge of reckless homicide.
