Mass. lawmaker, alleged assailant, reach agreement, no charges will be issued

FALL RIVER, Massachusetts — A state lawmaker and a man accused of assaulting him have reached an agreement and no criminal complaint will be issued, even though a clerk magistrate found probable cause to bring charges.

The deal between state Rep. Christopher Markey and David Oliveira reached Wednesday apparently closes the case.

The Dartmouth Democrat says he was using his phone outside a school on March 9 while one of his children was playing basketball inside when Oliveira shoved him, sending him to the hospital with a collapsed lung and sore ribs. Police said the altercation may have been sparked by Oliveira's failure to land a state job.

The Standard-Times (http://bit.ly/120gdEH ) reports that neither man would discuss terms of the agreement following a show-cause hearing during which probable cause to bring charges was found.
