Providence asks to delay Taveras' deposition in suit against actuary until after the primary

PROVIDENCE, Rhode Island — An attorney for a company being sued by the city says Providence Mayor Angel Taveras is the central witness in the lawsuit and wants to depose him sometime this month.

The city sued its longtime actuary Buck Consultants in February 2013 over what it called "fundamental and inexcusable errors" in calculating the projected savings from the city's pension overhaul — a mistake Providence says resulted in a pension liability of nearly $11 million more than expected.

The city asked a federal judge last week to delay Taveras' Aug. 19 deposition and limit it to three hours because of the Sept. 9 Democratic primary and pressing city business. Taveras is running for governor and faces Treasurer Gina Raimondo and former Obama administration official Clay Pell in the party primary.

The attorney for Buck Consultants objected Monday in filings with the U.S. District Court. The response argues Taveras is pivotal to the case and the depositions of city officials should begin with him. It also states Taveras was told he could pick any date in August, and he is not entitled to use his campaign as an excuse to avoid being deposed.

The suit says Buck overstated the city's savings by $700,000 a year, resulting in a pension liability of $10.8 million more than expected.
