Prosecutors will seek the death penalty for man charged in deaths of wife and her 2 children

DELAND, Florida — Prosecutors will seek the death penalty for a central Florida man accused of killing his wife and her young children.

Luis Toledo has waived his right to a speedy trial. He faces second-degree murder charges in the death of Yessenia Suarez and two charges of first-degree murder in the deaths of her children.

The Daytona Beach News-Journal reports (http://bit.ly/1e7tkJR ) that Assistant State Attorney J. Ryan Will has filed the notice of intent to seek the death penalty in the children's slayings.

Prosecutors say Toledo killed his wife during an argument. He told deputies that someone else killed the children.

Suarez and the children were reported missing Oct. 23, the day after a confrontation at her workplace. Their bodies have not been found.
