BILLINGS, Montana — A Billings man has been given a five-year deferred sentence for criminal endangerment for passing out intoxicated in a hot car with an 8-month-old baby inside.
The Billings Gazette reports (http://bit.ly/1EVLAZs ) 29-year-old Preston Michael Baumeister was sentenced Tuesday by District Judge Michael Moses. His sentence included a year in jail with all but 30 days suspended for misdemeanor driving while under the influence of alcohol or drugs. Baumeister has served 34 days.
Baumeister was arrested in August 2014 after police received a report of a man passed out in a car with an infant in the back seat.
Court records say Baumeister acknowledged consuming alcohol and hydrocodone earlier that day.
Moses told Baumeister the case was about two minutes from being a negligent homicide. The baby's temperature had reached 108 degrees.
