Lawsuit filed over Fayette County inmate death resolved through mediation

LEXINGTON, Ky. — A lawsuit filed over the death of an inmate at the Fayette County Detention Center has been settled.

Attorney Fred Peters, who represents the administrators of the estate of 54-year-old Dean Ferguson of Lexington, told the Lexington Herald-Leader (http://bit.ly/KrnH9i ) that the suit was resolved through mediation within the past several weeks. Peters said he wasn't allowed to discuss settlement amounts.

The lawsuit, against the Lexington -Fayette Urban County Government and others, contended he was the victim of "egregious and unjustifiable treatment" at the jail.

Ferguson was serving time on weekends after being convicted of drunken driving. He collapsed at the jail in July 2010 and died of a pulmonary embolism at the University of Kentucky Chandler Hospital. The lawsuit, against the Lexington-Fayette Urban County Government and others, contended he was the victim of "egregious and unjustifiable treatment" at the jail.

Susan Straub, spokeswoman for Lexington Mayor Jim Gray, said local government had no comment.
