DOVER, Delaware — A Delaware judge has ordered that a former soldier accused of kidnapping, raping and killing a Wilmington woman undergo a brain diagnostic test.
The judge on Friday ordered prison officials to take 26-year-old Dwight Smith to Christiana Hospital Dec. 4 for the test.
Smith is charged with killing 65-year-old Marsha Lee when he was on leave from Fort Drum, New York, in 2011. Prosecutors have said they intend to seek the death penalty.
After Lee's death, Smith wrote of concerns about his mental health and suggested that he became "addicted to killing" while in Iraq and Afghanistan.
Smith's attorneys say he has serious mental health issues. They're trying to have him transferred from Delaware's maximum security prison in Smyrna to a mental health pod in a Wilmington prison.
