New judge assigned to trial of man accused of killing Lockport woman and her 2 daughters


THIBODAUX, Louisiana — The trial for a man accused of killing a Lockport woman and her two daughters has been moved to a different judge for the third time.

The Courier reports ( ) newly elected state District Judge Christopher Boudreaux announced in a hearing Tuesday that he will not preside over David Brown's first-degree murder trial.

He was replaced by state District Judge John LeBlanc.

Brown, 37, of Houma, was arrested after 29-year-old Jacquelin Nieves and her daughters, 7-year-old Gabriela and 1-year-old Izabela, were found stabbed to death in their apartment Nov. 4, 2012.

Boudreaux was randomly selected for the case after Judge Steve Miller decided last week that he would not preside over it because, as an assistant district attorney, he prosecuted Brown on another charge that may be presented in the trial. Miller replaced Judge Jerome Barbera, who had presided over the case but retired last month.

Boudreaux, previously the chief indigent defender, replaced state District Judge Bruce Simpson, who also retired last month. He represented Brown early on in the case and cited that as a reason for recusing himself from it.

LeBlanc was randomly selected at the hearing to preside over the trial.

The Nieveses' bodies were found in a fire the Lafourche Parish Sheriff's Office has said Brown set to cover up the killings. Brown is also accused of raping Jacquelin and Gabriela Nieves.

Brown's trial is set for April 20 at the Lafourche Parish Courthouse. The defense is led by New Orleans-based attorney Kerry Cuccia.
