Only woman on Ohio's death row loses appeal; will go back to trial court for resentencing


COLUMBUS, Ohio — The only woman on Ohio's death row will be sentenced a third time for plotting the killing of her ex-husband.

Sixty-nine-year-old Donna Marie Roberts was sentenced to death in 2003 for plotting with her boyfriend to kill her husband in 2001 in Howland, in northeast Ohio.

The Ohio Supreme Court for the second time overturned Roberts' death sentence — but not her guilty verdict — last October and sent the case back for resentencing.

The Columbus Dispatch ( ) reports that the U.S. Supreme Court on Monday denied an appeal arguing that she should be allowed to offer mitigating evidence at sentencing about why she should not receive the death penalty.

She'll stay on death row until she's sentenced again.
