MISSOULA, Montana — The Montana Supreme Court has upheld a ruling that denied Carlyle Group's request to stop the valuation process of Mountain Water Co., which the city of Missoula is trying to take ownership of.
The city recently won a court ruling allowing it to purchase Mountain Water, but the condemnation case has not been finalized and Carlyle is still the owner.
The Missoulian reports (http://bit.ly/1hqUdRt ) that state Supreme Court found that Missoula County District Court was not mistaken when it denied Carlyle's motion to stop the trial phase until the high court has a chance to rule on Carlyle's appeal of condemnation.
The lower court found that the city was able to prove its plan for a city-owned water system is more necessary than its current use as a for-profit enterprise.
