VANCOUVER, Washington — The Clark County prosecutor says three members of a SWAT team were justified in shooting a bystander during a manhunt last Halloween.

Prosecutor Tony Golik says the three thought they were shooting at a fugitive, John Kendall, who had earlier shot and wounded a neighborhood at Hazel Dell.

The Columbian reports (http://bit.ly/1LUZFXl) the bystander, 55-year-old Brent Graham of Vancouver, had reported Kendall's abandoned car and stayed at the scene.

Despite the confusion, Golik says the officers were justified in firing eight shots. Graham was wounded in a leg. His lawyer says he plans to sue.

Kendall was later found dead of a self-inflicted gunshot wound.
