PLACERVILLE, California — California's attorney general has declined to seek a new trial against the former head nurse at a senior care facility who was accused of felony elderly abuse in the death of an Alzheimer's patient.
The Sacramento Bee reports (http://bit.ly/1aR7XcA) state officials said this week they won't seek another trial against Donna Darlene Palmer after an El Dorado County judge declared a mistrial when a jury failed to reach a verdict.
Palmer, ex-director of nursing at Placerville's El Dorado Care Center, was one of two nurses charged last year. Investigators say 77-year-old Johnnie Esco was supposed to be constantly monitored by nurses at the facility. But she died of fecal impaction in 2008 after 13 days in the nursing home.
Rebecca Smith, a licensed vocational nurse, pleaded no contest to felony elder abuse.
