Fort Madison man pleads guilty to lesser charge in shooting death of Burlington man


BURLINGTON, Iowa — A Fort Madison man facing a first-degree murder change in the death of a Burlington man has pleaded guilty to a lesser charge.

The Hawk Eye newspaper reports ( ) Lenard "Ray" Polhans entered the guilty plea Friday to voluntary manslaughter in Des Moines County District Court.

The 42-year-old Polhans had been set to go on trial Tuesday in the June 1 shooting death of 35-year-old Marvin "Whitey" Sutton.

Besides the manslaughter plea, Polhans pleaded guilty to being a felon in possession of a firearm and agreed to pay $150,000 in restitution to Sutton's family.

Polhans has maintained he was acting in self-defense after Sutton hit him in the back with a hammer.

He will remain in jail without bond as he awaits sentencing.
