Suburban Philly prosecutors not seeking death penalty against defendant in girlfriend's murder

NORRISTOWN, Pa. — Prosecutors in suburban Philadelphia say they won't be seeking the death penalty against a man charged in the strangulation slaying of his life-in girlfriend.

Montgomery County prosecutors announced the decision Monday at the formal arraignment of 39-year-old Johnny Fossett of Springfield.

Assistant District Attorney Tonya Lupinacci said authorities did not believe there were sufficient aggravating circumstances to warrant the death penalty.

Fossett is charged with first-, second- and third-degree murder in the Jan. 15 death of 40-year-old Lori Jefferson.

Fossett entered not guilty pleas to the murder counts as well as robbery, theft by unlawful taking and unlawful restraint charges.
