WILLISTON, North Dakota — A judge has refused to dismiss a felony manslaughter charge against a Williston man accused in a fatal hit-and-run.
David Krause is accused of manslaughter and leaving the scene of an accident in the Dec. 6 death of 31-year-old Anthony Scoggins outside a bar.
The Williston Herald reports (http://bit.ly/NFX0XS ) that defense attorney Jeff Nehring argued during a court hearing Wednesday that the incident was an accident, and the manslaughter charge should be dropped.
Prosecutor Nathan Madden maintained that Krause lied when he told investigators that he wasn't aware he had run over Scoggins.
Judge Joshua Rustad upheld the manslaughter charge and said a jury trial will be scheduled on both felony charges. He did not immediately set a date.
