CAPE GIRARDEAU, Missouri — A southeast Missouri prosecutor has dropped murder charges stemming from a bar fight, saying there isn't enough evidence to take the case to trial.
The Southeast Missourian (http://bit.ly/11W0YOl ) reports that Cape Girardeau County prosecutors announced Wednesday they were dropping charges against Malcolm U. Harris. He was charged with second-degree murder and armed criminal action following the shooting death of Nicholas Gilbert at The Spot nightclub in Cape Girardeau in December.
A preliminary hearing in the case had been scheduled for Tuesday. Prosecutors say they will refer the case back to Cape Girardeau police for further investigation.
