2nd mental health evaluation ordered for man in cancer fundraiser fraud case

TWIN FALLS, Idaho — A judge has ordered a second mental health evaluation for a 54-year-old Buhl man charged with holding a fraudulent fundraiser.

Michael Wayne Holley's defense attorney told 5th District Judge Randy Stoker on Monday that he had been trying to resolve the case with a plea agreement, but that Holley was adamant that he is innocent. Holley and his wife are charged with holding a fundraiser to help their daughter, who they said had cancer. The girl was not sick.

The Times-News reports (http://bit.ly/12xoxMz ) that when the judge told Holley he should discuss a possible plea agreement with his attorney, Holley went into a tirade, nearly hit his attorney with his cane and asked to be escorted from the courtroom.

Defense attorney George Essma told Stoker he didn't think Holley could aid in his defense.
