Police: Trucker was on cell phone when he struck and killed 92-year-old man in central NY

OTISCO, New York — The Onondaga County Sheriff's Office says a Solvay trucker was talking on his cell phone when he struck and killed a 92-year-old pedestrian in a crosswalk.

Gerald Merriman of Marietta died Nov. 10 after he was struck by a tractor-trailer driven by David Prentice on Route 80 in Otisco, 13 miles southwest of Syracuse. Deputies initially attributed the accident to poor weather conditions and visibility, and Prentice wasn't ticketed.

But Deputy Herb Wiggins tells the Syracuse Post-Standard Tuesday (http://bit.ly/1qYUBDE ) that a subsequent investigation showed Prentice was on his cell phone at the time.

Prentice is to be arraigned Oct. 7 on traffic tickets for a crosswalk violation and using a mobile device while driving.
