COLUMBUS, Ohio — A prosecutor is asking the Ohio Supreme Court to throw out a lawsuit that originally sought video from a University of Cincinnati police officer's fatal shooting of a motorist during a traffic stop.

Hamilton County Prosecutor Joe Deters says the issue is moot because he provided the video on July 29, the same day the officer was indicted and five days after the lawsuit was filed.

But Deters also said in a motion filed Friday he wouldn't object if the court looked at the overall issue of releasing such video in the midst of investigations since it was likely to come up again.

The lawsuit included plaintiffs The Associated Press, The Cincinnati Enquirer and Cincinnati television stations WCPO, WXIX, WKRC and WLWT.
