Delaware judge refuses injunction against sandwich shop that sold to Las Vegas strip club

DOVER, Del. — A federal judge in Delaware has refused to issue a preliminary injunction against the owners of a Las Vegas sandwich shop in a dispute stemming from sandwich sales to a strip club.

The Capriotti's Sandwich Shop company, founded in Delaware, argued that the Las Vegas shop owners violated their franchise agreement by selling sandwiches to the Crazy Horse III strip club, which advertised a promotion last fall offering patrons a six-inch Capriotti's sub and a beer for $5.

Capriotti's said the shop owners violated their agreement and sought an injunction preventing them from continuing to operate their franchise.

But the judge denied Capriotti's motion on Wednesday. He also refused the shop owners' request to dismiss the lawsuit but did grant their motion to have it transferred to Nevada.
