BOZEMAN, Montana — The Montana Supreme Court has upheld a lower court's ruling awarding a Bozeman couple more than $22,000 from a landlord police say shot one of the tenants.
The Bozeman Daily Chronicle reports (http://bit.ly/11MEmMS) the decision late last month affirmed a district court judge's ruling that awarded Henry and Kathy McDunn damages and attorney fees from 59-year-old Diana Arnold of Bozeman.
Arnold is charged with attempted deliberate homicide and aggravated burglary in the May 2012 shooting of Henry McDunn after she was ordered to pay the couple more than $22,000 from what started as a dispute over a $1,200 security deposit.
The amount ballooned as Arnold engaged in a series of losing court battles culminating in February 2012.
Arnold has pleaded not guilty to the criminal charges.
