More time allowed before RI judge rules on dismissal of lawsuit against Schilling's 38 Studios

PROVIDENCE, Rhode Island — The Rhode Island judge weighing arguments to dismiss a lawsuit filed by the state's economic development agency against Curt Schilling and others involved in the failed 38 Studios deal is giving lawyers time to submit more information before he rules.

Superior Court Judge Michael Silverstein set a June 12 deadline for additional briefs. The Economic Development Corp. suit names 14 defendants, including Schilling, other 38 Studios executives and former EDC officials who oversaw the $75 million loan guarantee deal. Silverstein could rule to dismiss some parts of the suit while letting others go ahead.

38 Studios' attorneys say executives disclosed everything about the company's finances and the suit should be tossed.

An EDC lawyer has described a "fraudulent scheme" in which the defendants provided false information to its board.
