Prosecutors say they won't seek death penalty if Mitchell man is convicted in fatal shooting

CHAMBERLAIN, South Dakota — Prosecutors say they will not seek the death penalty if a man accused of killing a Mitchell woman is convicted.

Thirty-six-year-old Kent Davidson is accused of fatally shooting 26-year-old Crystal Schulz in the head with a shotgun on March 11. Her body was found three days later in a shed at her mother's residence in rural Chamberlain.

Davidson is charged with first-degree murder. The charge has a minimum sentence of life in prison with the option of a death sentence.

The Daily Republic reports (http://bit.ly/12Jhuk4) that documents filed Friday show that the state reserves the right to revisit the death penalty issue "in the event of an unforeseen significant change in circumstances."

A spokesman for South Dakota Attorney General Marty Jackley said Jackley was not available for comment on Friday.
