BURLINGTON, Vermont — The lawyers for a man facing the federal death penalty for killing a Vermont woman are alleging more misconduct by jurors during the 2005 trial.
Federal court documents say a Barre man listed as Juror 27 in the trial of Donald Fell answered no when asked if he had ever been charged with a crime, but he was convicted of driving under influence in 1982 and was charged, but not convicted, of a 1981 assault.
The Burlington Free Press (http://bfpne.ws/1blmfsa ) is reporting the information is contained in a 411-page amended motion asking the federal court in Burlington for a new trial or a reduced sentence.
Prosecutors reject the claims.
Fell was convicted of the 2000 abduction and later killing of Terry King of North Clarendon.
