Fla. judge again refuses to dismiss MLB drug lawsuit against clinic

MIAMI — A judge has refused for a second time to dismiss a lawsuit filed by Major League Baseball against a South Florida clinic and its operators over allegations they provided banned substances to players.

Circuit Judge Ronald Dresnick on Wednesday denied the dismissal motion filed by the attorney for Carlos Acevedo, who managed a clinic called Biokem. That clinic was the predecessor to now-closed Biogenesis of America, which along with former operator Anthony Bosch is the main target of the MLB lawsuit.

The lawsuit contends the clinic and Bosch solicited players to purchase or use banned performance enhancing substances in violation of their contracts with MLB. No trial date has been set, but more motions are to be heard June 24.

Dresnick denied an earlier motion to dismiss on May 30.
