Butte man charged with attempted deliberate homicide, police say shot fired near child

BUTTE, Montana — A 37-year-old Butte man is charged with attempted deliberate homicide after police say he fired a shot inside his residence in the direction of a child who was lying in bed.

The Montana Standard reports (http://bit.ly/1ctqNPO) Earl Melvin Rauch made an initial appearance in Justice Court Tuesday and also was charged with two counts of criminal endangerment and partner-family member assault. He did not enter a plea. His bail was set at $300,000.

Butte-Silver Bow County Undersheriff George Skuletich says the man's wife left the house after an argument late on April 8. She called police at 1 a.m. on April 9 after one of her children called to report Rauch had fired a gun.

Rauch released three children, ranging in age from 9 to 15. Officers then negotiated his surrender.
