WILMINGTON, Del. — Lawyers for a man convicted twice of killing a University of Delaware student in 2005 are asking for another trial.
Figliola said a juror had been a witness to an alleged domestic violence incident between her husband and her daughter.
A jury convicted James Cooke Jr. the rape and murder of 20-year-old Lindsey Bonistall last month. The same jury also recommended 11-1 that Cooke be executed. The trial judge has the final say on execution; he has not set a sentencing date.
The News Journal of Wilmington (http://delonline.us/Jikjz2) reports that Anthony Figliola, one of Cooke's lawyers, has filed papers seeking another trial. Figliola said a juror had been a witness to an alleged domestic violence incident between her husband and her daughter. She had not revealed that information before trial.
Prosecutors have until June 4 to respond to the defense motion.
