School district won't have to pay $100,000 in case of teacher who had sex with student, 16

UNIONTOWN, Pennsylvania — A western Pennsylvania school district won't have to pay $100,000 to a former student who sued after a teacher, now 64, had sex with her while she was still a 16-year-old high school student.

The decision by the state Commonwealth Court found that officials at the Albert Gallatin Area School District weren't "deliberately indifferent" to the actions of the teacher, Donald Rosie, of Uniontown.

Rosie previously pleaded no contest to criminal charges that he had sex with the student in 2006, who also won a $200,000 verdict against him. The appeals court ruling doesn't disturb that verdict.

The Commonwealth Court's ruling was returned last month, but became official only after it was not appealed within 30 days.

The woman claimed the district should have done something after earlier complaints about Rosie's flirtatious behavior with other girls.
