Ivy Tech to host state appeals hearing

Indiana’s second highest court will conduct oral arguments at Ivy Tech Community College-Columbus at 10 a.m. Tuesday in the CLC Auditorium, Room 100.

A panel consisting of Judge John G. Baker, Judge L. Mark Bailey and Judge Melissa S. May will hear the case Andrece Tigner vs. the State of Indiana.

The appeal involves claims by Andrece Tigner, charged with Level 2 felony dealing in cocaine, Level 2 felony dealing in a narcotic drug, and six other counts related to the dealing or possession of illegal drugs, that evidence found when he and his vehicle were searched should be suppressed. The Marion County trial court denied Tigner’s motion to suppress, and he is pursuing an interlocutory appeal. He argues the officers lacked probable cause to conduct a search incident to arrest of his person inside of the residence, and Tigner contends the use of a key fob to identify his vehicle amounts to an unconstitutional search.

The event is open to the public and will last about one hour. This is the first Appeals on Wheels event this year. The Court of Appeals hears oral arguments across the state to enable Hoosiers to observe real world issues and learn more about the court’s role in Indiana government.
