SMITH, PETITIONER NOTICE OF ADOPTION D’Tric Demon Degroot is notified that a petition for adoption of a child, named Maverick Degroot, born on April 23, 2023 was filed in the office of the Clerk of Bartholomew County Circuit/Superior Court, 234 Washington Street, Columbus, IN 47201. The petition for adoption alleges that the consent to adopt of Maverick Degroot is not required because he has abandon the child for at least six months immediately preceding the filing of this petition as contemplated at Indiana Code 31-19-9-8 and he has failed without justifiable cause to communicate significantly with the child when able to do so as also contemplated at Indiana Code 31-19-9-8 and Petitioner will prove by clear and convincing evidence that D’Tric Demon Degroot is unfit to be a parent and that Maverick’s best interests would be serviced if the Court dispensed with D’Tric Demon Degroot’s consent as contemplated at Indiana Code 31-19-9-8(a)(11). If D’Tric Demon Degroot seeks to contest to the adoption of the child, D’Tric Demon Degroot must file a motion to contest the adoption in accordance with IC 31-19-10-1 in the above-named court not later than thirty (30) days after the date of service of this notice. If D’Tric Demon Degroot does not file a motion to contest the adoption within thirty (30) days after service of this notice the above-named court will hear and determine the petition for adoption. The consent to adoption of Maverick Degroot will be irrevocably implied and D’Tric Demon Degroot will lose the right to contest either the adoption or the validity of D’Tric Demon Degroot’s implied consent to the adoption. No oral statement made to D’Tric Demon Degroot relieves D’Tric Demon Degroot of D’Tric Demon Degroot’s obligations under this notice. This notice complies with IC 31-19-4.5-3 but does not exhaustively set forth a person’s legal obligations under the Indiana adoption statutes.
