A judge has dismissed a Level 5 felony domestic battery charge against a woman who had been accused of stabbing her boyfriend in an incident in the 1900 block of Shellbark Court on July 23.
Charges against Marie Hamilton, 33, of 1979 Shellbark Court, were dismissed by Bartholomew Superior Court 1 Judge James Worton on Monday at the request of Bartholomew County Prosecutor Lindsey Holden-Kay.
Holden-Kay told The Republic that the victim in the case had recanted and would not cooperate as a witness in the prosecution of the case, resulting in the need to dismiss the charge.
In the incident, the victim initially told investigators at the scene that Hamilton came at him with a knife and stabbed him in the leg, allegations he now has recanted in communication to prosecutors.
