Convicted armed robber to have hearing on petition to revoke his probation

A local man who received a nine-year-suspended sentence for armed robbery will have a hearing at 10 a.m. Thursday on a petition to revoke his probation.

Marc Mathis, 21, of 3510 W. County Road 300S, was arrested by Community Corrections officers Saturday afternoon on a probation violation at the Community Corrections offices. Bartholomew County Sheriff deputies took him into custody there. Mathis’ bond has been set by Bartholomew Circuit Court at $75,000.

Bartholomew County Sheriff’s Office said Mathis was arrested after suspected narcotics were found in a commons area of Community Corrections, which later tested positive for fentanyl. Community Corrections cited Mathis for a violation of probation in the incident, although Mathis denied being in the area where the drugs were found, according to investigators. Sheriff’s deputies took custody of the drug evidence as part of the investigation.

In June, Mathis admitted as part of a plea bargain to committing an armed robbery at a local gas station in August 2024 and received a suspended nine-year sentence in July in Bartholomew Circuit Court.

Mathis pleaded guilty to armed robbery as Level 3 felony on June 6 in relation a robbery he committed on Aug. 19, 2024 at a Circle K at 3470 W. County Road 450S.

Bartholomew Circuit Court Judge Kelly Benjamin ordered the suspended sentence and directed Mathis to the Bartholomew County Jail, but said he would be given the opportunity to enter into a work release program once a spot became available and then transition to a sober living facility as part of the plea agreement.

In addition, Mathis was to undergo a substance use and mental health evaluation, complete 200 hours of community service, and was asked to take a drug screening following sentencing. He was also ordered to have no contact with any Circle K locations.

Mathis had been in jail 142 days following arrest, and the judge ordered that as time served.

Testimony during the hearing and via a probable cause affidavit revealed that Mathis entered the Circle K just after 3:50 a.m. last August in a mask, displaying what appeared to be a black firearm. He tapped to get the clerk’s attention and asked for the money in the register.

The victim stated in testimony that Mathis apologized for what he was doing during the robbery, to which the clerk told him that he “didn’t have to do this.”

Mathis ultimately made off with $150, which he said was to fuel an addiction to fentanyl, according to court records. Mathis told the court he had been suffering from withdrawal and decided to drink alcohol and use meth as a means to cope that night, before making the decision to rob the gas station, court documents state.

The Circle K was nearby where he lived with his mother, according to court documents. Mathis stated he chose the time and location because he thought there wouldn’t be any patrons, and because he was aware that the clerk wouldn’t be allowed a firearm, per Circle K policy.
